LEGAL TERMS
1. User Referral
1.1. Each referral (the “Referral“) will be an Australian based company who has not previously engaged Future IT Services for the provision of services.
1.2. Referrer is not obliged to refer any companies (“Referred Company“) to Future IT Services and may enter into any other similar referral arrangement with other parties.
1.3. Future IT Services is not obliged to accept any users referred by Referrer and may enter into any other similar referral arrangement with other parties.
2. Method of Referral
2.1. The Referrer is to discuss the referral with any of the Future IT Services Management Team and have the Referred Company complete the Refer a Business form located at www.futurecomputers.com.au/referral
3. The Incentive
3.1. Depending on the value of the Referred Company, the Referrer will qualify for a different Referral Incentive as outlined below:

3.2.The Referral Incentive is due for issue by Future IT Services to the Referrer upon the following events occurring:
- The Referred Company entering into Fixed Fee Managed IT Services under a 12 Month Agreement.
- The Referred Company must enter into the agreement within 3 months of the referral form completion date.
3.3. Future IT Services will issue the Referral Incentive within 30 days from the agreement being signed by the Referred Company.
3.4. Future IT Services retains the right, at its complete discretion to alter or amend the Referral Incentive. Future IT Services must give the Referrer 24 hours notice in the event that the Referral Incentive is altered or amended.
3.5. It is understood by the Referrer that it is their responsibility to ensure that accepting the Referral Incentive is permitted and does not conflict with their employer’s company gift policy.
4. Referred Company
4.1. The Referred Company will receive 25% off the first month of their agreement upon entering a Fixed Fee Managed IT Services agreement for a minimum of 12 months or the up front transition fee waived as part of this referral.
4.2. The Referred Company must provide legitate Referrer details (name of the Referrer and the Referrer’s email address) at the time of completing the referral form found at www.futurecomputers.com.au/referral, to qualify for the discount referenced in 4.1.
5. Privacy Protection
5.1. Future IT Services agrees to keep all Referred Company information confidential in accordance with its Privacy Policy that can be found at www.futurecomputers.com.au/privacy-policy.
6. Restrictions
6.1. Future IT Services has placed a number of restrictions around the referral program. These restrictions are set out below:
- NOT ALLOWED: Referral of any non-Australia based Referred Users.
- NOT ALLOWED: The Referrer must not refer companies that have not been notified that the referral will take place.
- NOT ALLOWED: Conducting fraudulent activity. Fraud is a serious offense and will be treated as such. Fraud is defined as any action that intentionally attempts to create sales, leads, or click-throughs using robots, frames, iframes, scripts, or manually “refreshing” of pages, for the sole purpose of creating commissions. ANY ATTEMPTED FRAUD OR FRAUD WILL RESULT IN TERMINATION OF THIS AGREEMENT AND VOID THE REFERRAL INCENTIVE.
7. No Agency
7.1. This Agreement does not create any legal or fiduciary relationship between the parties.
7.2. Referrer, its employees, servants or agents must not represent, convey or in any way make out to be an agent, partner, representative, employee, contractor or affiliate of Future IT Services.
7.3. Neither party shall have any right, authority or permission to legally bind the other party to any contract, arrangement or obligation.
8. General Provisions
8.1. Future IT Services may amend this Agreement by providing notice via the Refer a Business webpage: www.futurecomputers.com.au/referral
8.2. In the event that any provision of this Agreement is held to be invalid, illegal or unenforceable, then such provision will be fully severed and the Agreement will be construed and enforced without that severed provision.
8.3. The rights created under this Agreement are non-assignable. For the avoidance of doubt:
- no future Referral Incentive will be due and payable to Referrer if this Agreement is terminated pursuant to clause 7, whether the right to the Referral Incentive arose prior to the termination or otherwise.
